Congress Ministries: Civil Liberties and Agrarian Reforms

Modern History › Congress After Civil Disobedience and the Provincial Ministries · Topic 21.4

The Congress ministries governed several provinces for 28 months, until October 1939. Gandhi advised holding office lightly, as crowns of thorns. They eased curbs on civil liberties, releasing prisoners and lifting bans, though with some blemishes, and passed laws on land reform, debt relief and tenures, within constraints that prevented the abolition of zamindari; benefits went mainly to tenants with rights.

Where Does It Fit?

This is the fourth topic of the category on the Congress after civil disobedience and the provincial ministries. The previous topic covered the 1937 elections. This topic covers the work of the ministries on civil liberties and land. The next topic covers labour, social welfare and an evaluation. Previous topic: Congress in the 1937 Elections.

What Was Gandhi’s Advice to Congress Ministers?

Congress ministries were formed in Bombay, Madras, the Central Provinces, Orissa, the United Provinces and Bihar, and later also in the North-West Frontier Province and Assam. Gandhi advised Congressmen to hold offices lightly and not tightly. They were to be seen as crowns of thorns, accepted to see whether they quickened the pace towards the nationalist goal, and to be used in a way not expected or intended by the British. He urged Congressmen to prove that the Congress could rule with the least assistance from the police and the Army. The elections that brought them to office are in Congress in the 1937 Elections.

What Was the Mood and What Were the Limits?

There was great enthusiasm among the people, as suppressed mass energy was released. The Congress’s prestige rose because it showed that it could not only lead the people but also use State power for their benefit. But the ministries had basic limits: through administration they could not change the basic imperialist character of the system, and they could not introduce a radical era. In the 28 months of Congress rule some efforts were made for people’s welfare.

What Did They Do on Civil Liberties?

The ministries did much to ease curbs on civil liberties.

Measure Detail
Emergency powers Laws giving emergency powers were repealed
Bans The ban on illegal organisations such as the Hindustan Seva Dal and Youth Leagues, and on certain books and journals, was lifted
Press Press restrictions were lifted and newspapers were taken off blacklists
Arms Confiscated arms and arms licences were restored
Police Police powers were curbed and the CID stopped shadowing politicians
Prisoners Political prisoners and revolutionaries were released and deportation and internment orders revoked
Bombay Lands confiscated during civil disobedience were restored
Pensions Pensions of officials linked with the civil disobedience movement were restored

Some blemishes marked the record. The Madras government arrested the socialist Yusuf Meherally for inflammatory speeches, and he was later released. The socialist S.S. Batliwala was arrested for a seditious speech by the Madras government and given six months. K.M. Munshi, the Bombay home minister, used the CID against communists and leftists. The earlier repression that these measures reversed is in Third Round Table Conference and the Resumption of Civil Disobedience.

Why Could the Ministries Not Abolish Zamindari?

The Congress ministries could not overhaul the agrarian structure by completely abolishing zamindari, because of basic constraints.

Constraint Detail
Powers The ministries did not have adequate powers
Finance Resources were inadequate, since the Government of India took the lion’s share
Class adjustment Zamindars and others had to be conciliated and neutralised
Time Congress politics was about confrontation, and not cooperation, with colonialism
War clouds They began to gather around 1938
Second chamber The Legislative Council, dominated by landlords, moneylenders and capitalists in the United Provinces, Bihar, Bombay, Madras and Assam, had to be conciliated for legislation
Complexity The agrarian structure was too complex

What Did They Achieve in Agrarian Matters?

Despite these constraints, the ministries legislated a number of laws on land reform, debt relief, forest grazing fees, arrears of rent, land tenures and related matters. But most of the benefits went to statutory and occupancy tenants, and sub-tenants gained little. Agricultural labourers did not benefit, because they had not been mobilised.

As an analytical point, the pattern is clear: the ministries could help the groups who already had a legal claim to the land, such as occupancy tenants, but could not reach those below them, since the legislation worked through the existing tenure structure and the support of the upper chambers, and the labourers had no organised voice. This is consistent with the manifesto promises of rent and debt relief in Congress in the 1937 Elections, which were met in part. The labour and welfare policy is in Congress Ministries: Labour Policy, Social Welfare and Evaluation.

What blemishes marked the ministries' record on civil liberties?

The Madras government arrested the socialists Yusuf Meherally and S.S. Batliwala for speeches, with Batliwala given six months, and K.M. Munshi, the Bombay home minister, used the CID against communists and leftists, which drew criticism from the left.

Why could the ministries not abolish zamindari?
