Where Does It Fit?

Articles 5 to 8 said who became a citizen at the commencement. Article 9 says who cannot be one. It is the constitutional basis of the rule that India has single nationality and no dual citizenship.

What Does Article 9 Say?

No person shall be a citizen of India, or be deemed to be a citizen of India, if he or she has voluntarily acquired the citizenship of any foreign state. The Indian Constitution therefore forbids dual citizenship or dual nationality.

How Does the Citizenship Act Apply the Rule?

The Citizenship Act, 1955 prescribes three ways of losing citizenship, and termination is the one that applies Article 9. By termination, when an Indian citizen voluntarily acquires the citizenship of another country, his or her Indian citizenship automatically terminates. Voluntarily means consciously, knowingly and without duress, undue influence or compulsion. The provision does not apply during a war in which India is engaged.

A related rule applies to children. A minor who is a citizen of India by descent and is also a citizen of any other country ceases to be a citizen of India if he or she does not renounce the citizenship or nationality of another country within six months of attaining full age.

Why Is the OCI Not Dual Citizenship?

The Citizenship (Amendment) Act, 2005 expanded the grant of Overseas Citizenship of India to persons of Indian origin of all countries except Pakistan and Bangladesh, as long as their home countries allow dual citizenship under their local laws. The OCI is not actually dual citizenship, because the Indian Constitution forbids dual citizenship or dual nationality under Article 9. An OCI cardholder remains a citizen of another country and is not entitled to rights such as voting or election to Parliament.

How Does This Fit with Single Citizenship?

The Constitution provides only a single citizenship, the Indian citizenship, with no separate state citizenship. Article 9 completes this by ensuring that a person cannot also hold the citizenship of a foreign state.
