River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016

Environment & Ecology › Protected Areas Lists and Recent Developments in Environment · Topic 20.20

The River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016 was issued by the Ministry of Environment, Forest and Climate Change on 7 October 2016 under the Environment (Protection) Act, 1986, to give a stronger legal and institutional framework for rejuvenating the Ganga and its tributaries. It replaced the 2009 order that had created the National Ganga River Basin Authority (NGRBA), which had been set up after the Ganga was declared a National River in November 2008. The 2016 Order set up a layered structure. The National Council for Rejuvenation, Protection and Management of River Ganga, called the National Ganga Council, is chaired by the Prime Minister and gives overall direction and oversight. An Empowered Task Force, chaired by the Union Minister for Water Resources (now Jal Shakti), supervises implementation. The National Mission for Clean Ganga (NMCG) is the implementing authority, and it has powers to issue directions, including to industries and local bodies, and to coordinate programme delivery. At the state level there are State Ganga Committees, and at the district level there are District Ganga Committees in districts through which the Ganga and its tributaries flow, headed by the District Magistrate. The Order allows the NMCG to take measures such as regulating activities that pollute or harm the river, controlling groundwater use in the river basin, and ensuring minimum ecological flow. The Order also lets the authorities take action against polluters. Hedge details: the structure is revised from time to time, so check the latest notifications.

  • River basin management: integrated plan for the basin
  • Public participation: Ganga Praharis and Ganga Mitra volunteers
  • Real time monitoring: water quality stations along the main stem
  • Industrial effluent: grossly polluting industries are inspected
  • Sewage: the largest source of pollution
  • Tannery issue: Kanpur tanneries relocation and effluent plants
  • NGT role: oversees Ganga cases including M.C. Mehta v. Union of India (Ganga pollution)

  • Link to next: see Smart Ganga City Scheme
  • Link to mission: see National Mission for Clean Ganga and Ganga Task Force
  • Caution: the structure and funds change, so check NMCG notifications
  • Exam hint: remember 7 October 2016, PM as chair and NMCG as implementer
  • Why a new Order: The earlier authority met rarely and lacked statutory enforcement, so the new structure aimed at faster decisions and clearer accountability
  • Cooperative federalism: State Ganga Committees bring Uttarakhand, Uttar Pradesh, Bihar, Jharkhand and West Bengal into planning and monitoring
  • Role of the Prime Minister: Chairing the Council signals political priority and helps to resolve disputes between ministries and states
  • Role of the DM: District Magistrates can act on encroachment, illegal discharge and waste management with police and local bodies
  • Compliance powers: Directions can cover closure of units, stopping water or power supply and prosecution under the EP Act
  • Reporting: NMCG reports progress of projects, sewage treatment capacity and water quality to the Council
  • Basin plan: Planning on a river basin scale, not town by town, is a key aim

Why Does It Matter for the Exam?

  1. Order: 7 October 2016
  2. Act: EP Act, 1986
  3. Chair: PM chairs the Council
  4. Current affairs link: National Ganga Council meetings
  5. Common errors: confusing NGRBA with the National Ganga Council

As an analytical point, the 2016 Order gave the river a clear chain of command from the Prime Minister to the district, but delivery still depends on sewage treatment, industrial compliance and local participation.
